Terms Of Use

1: Introduction
The following Terms Of Use apply to all recruitment and job sites operated by Innovate Recruitment Limited, and apply to all Clients, Advertisers, Recruitment and Employment Agencies and Candidates and Job Seekers. These terms are deemed to be accepted by all clients, advertisers, recruitment agencies and candidates by virtue of the use of the site for the purposed of securing employment, advertising vacancies, on registration or the placing of an advertisement, or the forwarding or inputting of information or data of any type.

A: Scope Of Terms
The following Terms of Use apply to the Innovate Recruitment Limited (IRL), and all websites and on-line resources, recruitment sites and job boards operated by IRL, including DublinCityJobs, CorkCityJobs, BelfastCityJobs and WorkLocal.ie, and any or all websites operated by the company (Websites).IRL reserve's the right to vary or update the Terms of Use, at any time and without notice. Users are responsible for reviewing information contained in the Terms OF Use, and continued usage constitutes acceptance of these terms.

B: Employers, Recruiters, Advertisers
Use of the above websites by employers, recruiters, agencies and public bodies, job seekers and candidates are subject to these terms and conditions.

C: Terms apply to all site features and functionality
The terms and conditions also apply to the use and application of all features associated with the sites, including Job Searches, Job Alerts, CV Upload, Hot Jobs, CV Searching, Candidate and Company Profiles, Email Application forms etc.

D: Terms apply to third party areas and use of control panel.
The terms of use apply to third party areas such as the User Control Panel, or any such areas as users are given access to.

All information, functionality, features, logos, artwork, text and site content is copyright, and the property of Innovate Recruitment Limited (IRL)

F: Privacy
IRL is committed to safeguarding the privacy of advertisers and site users. Please see our Privacy Statement for more details.

Advertiser / Employers / Recruiter (Clients) Terms Of Use.
class="mednormal">2: By registering, whether on line or by telephone, email or fax or any other method, clients are deemed to have accepted the Terms Of Use contained herein, in full, and to be bound by these terms.

3: Clients agree to maintain and respect the confidentiality of any or all information provided by candidates and job seekers in reply to advertised positions, and not to pass this information to third parties, without the express permission of the said candidate or job seeker.

4: IRLL undertakes to keep all relevant information supplied to it by the client confidential, and not to reveal this information to any third parties. This does not apply to registration information and company details and profile which is visible to all visitors to the site, but does include relevant information in the case of 'Blind Job Posting', where employer, advertiser information is hidden. IRLL also undertakes not to reveal username and password information to any third party.

5: While every precaution is taken to maintain the confidentiality of all information supplied to it, or held on-line, or inputted to the on-line database, no information held in such circumstances can be regarded as 100% secure. As a result IRLL cannot provide a 100% guarantee for the security of any information supplied by Clients or Candidates, by whatever method, whether held on-line or during transmission. All users should be aware that all information is supplied at their own risk. This exclusion also applies to third party links and websites which may be accessed from any of the websites detailed above.

6: All advertising fees are payable in full in advance. Payment may be made by credit card, cheque, direct debit or money transfer on the placing of an advertisement. Payment is due irrespective of the duration for which the advertisement remains live and irrespective also of the suitability or number of replies received. Advertisements are place for 60 day periods or multiples thereof, and should be visible to job seekers and candidates 24/7 for this period. While every effort will be made to ensure that advertised positions are visible to site visitors at all times, IRLL cannot accept liability for any periods during which the site may be unavailable, whether for technical or maintenance reasons, or other factors outside our control.

7: Advertisements placed following credit card registration and payment will be immediately visible to site visitors. Unless otherwise arranged / arranged in advance, advertisements may not be placed until the client account is activated, subject to agreed payment or invoicing terms.

class="mednormal">8: It is a strict condition of these Terms Of Use that all advertisers details and job vacancy advertisements are guaranteed genuine and legal by the advertiser. While irl takes every care to ensure that all advertisements placed are accurate, legal, decent and comply with all existing national and European legislation pertaining to same, irl cannot accept responsibility for the content, accuracy or legality of any position advertised, or for the conditions of employment operated by any client. In the event of any dispute in relation to the above the decision of irl in relation to same is final.

9: Where a client purchases a long term job board advertising contract or other contract with irl, the client is obliged to give 60 days advance notice in writing of cancellation of such contract. In the absence written notice, irl will continue to invoice the client for these services, until such written cancellation is received. In addition an administration charge of €75.00 plus VAT will be applied to each cancellation, or 10% of the overall fee, which ever is the greater.

10: Where a client removes an advertisement prior to the expiry date for that position or advertising package, no refund is payable to the client for any unused time, and the client will be invoiced for the full period including unused time at the appropriate rate. Where a Job advertisement is removed prior to the expiry date for the Job Pack purchased, an alternative position may be substituted at no extra charge, and this position will be visible up to the original expiry date.

11: irl reserves the absolute right, and without giving reasons, or entering into discussions, to decline, cancel or remove any advertisement or service for any reason and at any time without prior notice.

12: It is the responsibility of clients to ensure that all advertisements are accurate and legal and do not discriminate on the grounds of sex, race, religion, age, disability, and that all advertisements comply with all relevant Irish national and EC regulations in relation to same. irl cannot accept responsibility for any loss or damage to the client as a result omission, or failure to comply with the relevant regulations. irl reserves the sole right to remove any advertisements without prior notice, which it considers breaches or may breach these regulations.

13: irl will endeavour to activate client accounts and publish advertisements or provide the services on an the due date. irl does not accept any liability for any consequences or losses incurred, or any delay in the provision of the services agreed, and irl has the sole right to decline to publish, omit or suspend any job advertisements on the basis of late payment or client accounts, or to change any advertisement deemed by it to be unsuitable or illegal.

14: All non credit card client accounts are payable within 7 days of their account and advertising and CV view pack being live. irl reserves the right to suspend service without notice in the event of a client account remaining unpaid. irl reserves the right to charge interest at 12% per annum on all overdue client accounts, plus administration charges in the amount of €25.00 per month, on overdue accounts.

15: irl may at it's sole discretion report any advertisement deemed to be illegal to the relevant authorities.

16: irl reserves the right to make changes to the services provided, security systems, relevant charges, operating procedures etc without prior notification to the clients.

17: irl does not ant any time guarantee or warranty the quality or number of CV's that may be viewable on the site using the CV Views package, or replies that may be received by the advertiser as a result of placing an advertisement on any of the irl sites.

class="mednormal">18: Any advertisement placed by the client on any of the IRLL sites may be expired by the client at any time. The client will be charged for the period originally contracted, subject to IRLL receiving 60 days notice of the service no longer being required. This clause only applies to advertising contracts in excess of 60 days. No refunds are allowed for 30 or 60 day contracts.

19: Each Job advertisement may only contain one Job Title, and may not contain multiple job titles, as this prevents the database being properly searched by candidates.

20: IRLL will appoint a recruitment consultant to assist each Client in the use of the site and in the placing of advertisements.

21: A clients profile and company details will, unless otherwise requested, remain live on the IRLL site, even if no jobs are listed, and the Job and CV View pack purchased has expired. Clients may hide their company details by logging in and selecting the appropriate option. However, due to the nature of online data transfer, IRLL cannot guarantee the 100% confidentiality of client details held online.

22: Featured Clients are displayed in random in groups of 10. IRLL cannot guarantee the frequency at which a particular Featured Client logo or name will be displayed.

23: Obligations Of The Client: Employers and Advertisers
1: The client shall keep confidential their Username and Password, and not reveal it to any third party.

2: In compliance with the Data Protection Act as may be in force ant any time, the client is not allowed to reveal a candidates details to any third party.

3: A client may not act for any third party, directly or indirectly, in placing an advertisement.

4: The client hereby indemnifies IRLL against any and all risks as a result of any advertisement placed by them.

5: The client warranties that any information supplied by the client is accurate, complete and true.

class="mednormal">7: The client warranties that each advertisement placed by the client is legal, decent, honest, and accurate, and complies with all applicable laws, rules, regulations, and in addition, complies with advertising codes of practice. 7: The client undertakes to comply with the data protection act as may be in force in Ireland or the EC at any time.

8: The client is responsible for ensuring that all content submitted by them for publishing on any IRLL sites is not discriminatory, obscene, defamatory or in any way illegal, or is in breach of any legislation, and in ensuring that all content complies with all relevant industry coded of practice.

9: The client indemnifies IRLL against all claims made by third parties, in respect of data, or misuse of data or information supplied to or by the client.

10:It is the responsibility of the client to independently satisfy themselves as to a candidate’s skills, experience, qualifications, integrity and suitability and obtain suitable reference prior to offering employment to or employing any candidate.IRLL does not warranty the accuracy of information placed on the site, included in CVs, or a candidate's details, or forwarded by a candidate to a potential employer, advertiser or recruitment agency.

11: In addition to satisfying themselves as to the suitability or otherwise of a candidate, the client is responsible for ensuring that the candidate(s) are legally entitled to take up such employment as may be offered, and for ensuring that where required, that candidates have valid work permits.

12: It is the responsibility of the client to ensure that their employees or agents do not abuse the site, upload malicious software, or add spurious information via the control panel. IRLL reserves the right to take appropriate action, including seeking legal redress for damage caused by such misuse or malicious intent on the part of a client, user, their employees or agents.

23: Obligations Of The Client: Recruitment Agencies.
In addition to the obligations of the Employer Advertisers, as set out before, Recruitment Agencies undertake as follows.

1: To use CV obtained through IRLL for the sole purpose of endeavouring to locate suitable employment on their behalf.

2: Not to pass candidate details to third parties without the candidate's permission.

3: To comply with the requirements of the data protection act, as may be in force at any time in relation to information forwarded to them by candidates as part of their endeavours to secure suitable employment.

4: To comply with all national legislation and regulations in relation to recruitment and employment agencies.

5: to obtain the express consent of candidates prior to submitting his or her CV to any potential employer.

class="mednormal">24: Obligations Of Candidates and General Users
Candidates and Job seekers are obliged to use IRL websites, and website functions solely for the purposes for which they are intended, ie securing employment through our advertisers. Candidate may register and place their personal details online in order to use the job board services, and do so entirely at their own risk. IRLL is not liable for misuse of information submitted by any candidate by any third party. IRLL reserve the sole right to remove a candidates details from the database, without prior notice or discussion, where candidates are found to be in breach of our Terms Of Use

25: Security

While every effort is made by IRLL and our internet service provider to ensure the integrity and security of IRLL operated web sites, IRL makes no warranty in relation to security, content, computer viruses, or malicious programs, or that the sites will operate without interruption or error free. IRLL does not accept liability for any loss or damage, however caused, as a result of any breaches of security. This exclusion also applies to CV or data submitted on diskette, email or otherwise to agencies and potential employers by candidates.

26: Jurisdiction These terms shall be governed by, and in accordance with the laws of The Republic Of Ireland.
